Starting today, the statutory minimum wage level in Hong Kong has been raised from HK$40 per hour to HK$42.1 per hour. According to the Minimum Wage Ordinance, employees, whether they are on a monthly, daily, hourly, piece-rate, full-time, part-time, permanent or temporary basis, and regardless of whether they are employed under a continuous contract as defined by the Employment Ordinance, are entitled to the protection of the statutory minimum wage. Disabled employees are also entitled to the protection of the statutory minimum wage. The Minimum Wage Ordinance provides special arrangements for disabled employees to choose to undergo an assessment of their capacity for work, to determine the minimum wage they should receive, which should not be lower than the statutory minimum wage, or to receive a wage based on their assessed capacity for work. Employers who choose special arrangements for disabled employees must pay wages calculated at least at the new statutory minimum wage level and the assessed capacity for work level.
