Xu Xiaoli, a partner at Hebei Linghang Law Firm, stated in an interview with China News Service that using images of individuals for commercial promotion without their consent may constitute infringement of portrait rights. If sensitive information such as private conversations is involved, it may also violate privacy rights. In the event of infringement, businesses may be held responsible for stopping the live broadcast, compensating for losses, and even facing public security penalties. Xu Xiaoli suggested that businesses should establish clear territorial plans before live streaming or obtain written consent from customers in order to avoid legal risks.
