Regarding food safety, the Market Supervision Administration openly solicits opinions.
Today, reporters learned that the State Administration for Market Regulation has revised the "Food Recall Management Measures" and is now seeking public opinions.
The draft for public opinions clearly defines the scope of recalls, including food products that do not meet safety standards, have evidence of potential harm to human health, or fall under other prohibited production and operation situations as stipulated by laws and regulations.
It also specifies the forms of recalls. Food recalls can be initiated voluntarily or mandated by authorities, with different requirements for public announcements, recall disposal report submission, etc., to ensure precise and efficient implementation of food recalls. Food producers and operators who become aware of their products meeting the criteria for recall must immediately cease production and operation, initiate a recall, and make recall announcements through their own websites, other media, and the national food recall information platform. They must also report the recall and disposal within 5 working days after completion of recall. Failure to voluntarily initiate a recall as per the regulations will result in authorities mandating the recall. Upon receiving a mandatory recall notice, the food producer must publish the mandatory recall announcement on the national food recall information platform marked with the word "mandated".
The Measures stipulate that the production commissioning party must proactively implement food recalls as per the regulations and notify the commissioned party to cease production activities and identify risks. It also separately specifies the recall obligations and responsibilities of import food traders, cross-border e-commerce entities, and other relevant parties, as well as the execution of the Measures for edible agricultural products.
The Measures increase penalties for those who refuse to recall or cease operations after being ordered to do so, with penalties potentially calculated based on the value of the products in the same batch to address the issue of weak willingness of food producers and operators to voluntarily recall due to low penalties.
