On August 29th, Eastern Time, foreign media reported that officials from the Trump administration warned on Friday in front of the Federal Circuit Court of Appeals that ruling Trump's global tariffs illegal would seriously harm US foreign policy. Treasury Secretary Benson warned that this would lead to "dangerous diplomatic embarrassments". The White House submitted statements from Benson, Commerce Secretary Lutnick, and Secretary of State Rubio to the Federal Circuit Court in Washington. The court is expected to soon rule on whether Trump has exceeded his authority to impose tariffs under the 1977 Emergency Powers Act. During the oral arguments on July 31st, the judges were skeptical of the government's claim to have broad tariff powers, implying that they might support a challenge brought by a coalition of small businesses and Democratic-run states. Several cabinet members stated that invalidating the tariffs would overturn the results of months of negotiations with the EU, Japan, South Korea, and other countries. "The suspension of tariff powers would expose the US to the risk of retaliatory actions from other countries, as they may perceive that the US lacks the ability to respond to retaliation quickly," Benson said.
