In order to further standardize the administrative penalties of the Internet Information Department, protect the legitimate rights and interests of citizens, legal persons and other organizations, the National Internet Information Office recently publicly solicited opinions on the "Provisions on the Application of Standards for the Discretion of Administrative Penalties by the Internet Information Department". The deadline for feedback is June 14th of this year. The consultation draft proposes that for the same illegal act of the parties, administrative penalties of more than two fines shall not be imposed. The discretion standard of administrative penalties by the Internet Information Department is divided into no penalty, reduced penalty, mitigated penalty, general penalty, aggravated penalty, etc. Among them, those who have been subjected to administrative penalties by the Internet Information Department two or more times within one year for the same illegal act; those who incite, coerce, or deceive others to commit illegal acts; those who refuse to cooperate, obstruct, or threaten Internet Information Department law enforcement officers with violence to perform their duties in accordance with the law, should be punished more severely. In addition, the consultation draft proposes that when multiple legal norms are violated for the same illegal act and a fine punishment is required, the punishment should be based on the higher amount of the fine. For two or more illegal acts that require administrative penalties, they should be independently assessed and combined for punishment.
