The Colorado Supreme Court on Monday rejected efforts by ExxonMobil and Suncor Energy to dismiss a lawsuit filed by the city of Boulder holding these two fossil fuel companies accountable for climate change. In a 5-2 ruling, the Colorado Supreme Court stated that federal law does not prevent Boulder and its surrounding counties and cities from accusing these two energy companies of misleading the public about the dangers of fossil fuels, thus violating state laws. This decision marks the second time in the years-long litigation when the state's highest court has allowed state and local governments to sue large energy companies over climate change. The Hawaii Supreme Court allowed a similar lawsuit against Exxon, Sunoco, and several other companies to proceed, and the US Supreme Court declined to review that decision in January of this year. Boulder filed the lawsuit in 2018, alleging that these companies violated multiple state laws and caused public and private disturbances by misleading the public about the role their fossil fuel products play in exacerbating climate change.
