Supreme Court: Research and formulate normative documents on judicial protection of AI-related cases and data property rights
The State Council Information Office held a series of theme press conferences on "Starting the '15th Five-Year Plan'", introducing the relevant situation of "Advancing the Comprehensive Rule of Law". At the press conference, Liu Guixiang, Vice Ministerial-level Full-time Member of the Adjudication Committee of the Supreme People's Court and Second-level Senior Judge, stated that the people's court will adhere to the principles of "two unswerving", implement the Law on the Promotion of Private Economic Development, and protect the legitimate rights and interests of various market entities equally in accordance with the law. Efforts will be made to address economic disputes through criminal and administrative means, especially issues related to profit-seeking and irregular cross-border judicial activities, and to improve the mechanism for preventing and correcting wrongful cases in a normalized manner. Accelerating the introduction of judicial interpretations of the Company Law, promoting the construction of China's modern enterprise system with Chinese characteristics, focusing on the use of corporate legal systems to balance the interests of shareholders, creditors, and other parties according to the law. Implementing credit punishment accurately in enforcement, improving the credit repair mechanism, and promoting integrity-oriented behavior. Consolidating and expanding the advantages of fair and efficient trial in foreign-related cases in China, focusing on creating preferred venues for resolving intellectual property rights and international commercial disputes. Thoroughly studying new types of cases such as virtual currency and cross-border finance and expediting the formulation of judicial interpretations on civil compensation for insider trading and market manipulation to safeguard the stable operation of the capital market and effectively protect the legitimate rights and interests of small and medium-sized investors. Addressing new business formats in the digital economy, studying and formulating normative documents on judicial protection of cases involving artificial intelligence and data property rights. Improving the rules on data ownership, data transactions, AI generation, etc., promoting the deep integration of digital technology and the real economy, assisting in improving the basic institutional system of data elements, promoting the construction of an integrated data market that is open, shared, and secure.
