State Administration for Market Regulation: Stop typical unfair competition behaviors.
Notice from the State Administration for Market Regulation on further implementing the Anti-Unfair Competition Law of the People's Republic of China. The notice points out that in order to meet the requirements of high-quality development and the development of new productive forces, efforts should be continuously increased to crack down on common and high incidence acts of unfair competition such as counterfeiting and confusion, false advertising, infringement of trade secrets, and unfair sales with prizes, in order to promote the creation of a fair competition market environment. It is important to correctly understand the elements of unauthorized use of others' product names as search keywords, false transactions, false evaluations and to reasonably define the legal responsibilities of those who assist in confusion and those who sell illegal products, without overly broadening the scope of protection or tolerating illegal activities. Following the principle and spirit of investigating bribery and corruption together, implementing the new regulations on regulating the recipients of bribes in the commercial bribery clause, paying attention to distinguishing between kickbacks, commissions, fees, and other forms of payments in practice, and handling the relationship with other relevant laws properly.
