U.S. consumer electronics giant Apple Inc. (AAPL.US), while ramping up its foldable iPhone and AI growth businesses, is facing a patent damages award of more than $5.7 billion related to haptic technology. On September 25, a federal jury in California found that Apple Inc.'s Taptic Engine used in some iPhones and Apple Watch infringed two patents held by Taction Technology. Apple Inc. denies using the other party's technology and has made clear it will appeal.
Therefore, this is a jury verdict that may still be affected by subsequent judicial proceedings, and the market has not ultimately interpreted it as Apple Inc. having already paid damages. For investors, the focus is on the final liability and its cash flow impact, rather than directly judging from this that a reversal has occurred in the competitiveness of Apple Inc.'s core products.
From an engineering perspective, haptic feedback is an interactive capability formed jointly by mechanical actuators, vibration damping, and control systems, and is also an important part of the high-end device experience. The previous appellate dispute involved how the patent claim for "highly damped output" should be interpreted, and whether it could be limited to mechanical damping. This dispute is also a reminder to every investor in the market focused on large-cap stocksthe subtle differences in experience that users feel may likewise correspond to significant intellectual property costs.
Haptic patent dispute not yet over, $5.7 billion damages awarded to Taction Technology
According to U.S. media reports, a federal jury in California ruled on Friday that Apple Inc. (AAPL.US) must pay more than $5.7 billion in massive damages to Taction Technology for infringing patents related to haptic technology.
At the core of the case are two patents that Apple Inc.'s Taptic Engine is accused of infringing, namely U.S. Patent Nos. 10,659,885 and 10,820,117. Haptic feedback refers to the vibrations produced by an iPhone or Apple Watch when touching the screen, typing, and switching operations.
The lawsuit was initially filed in 2021. Although a judge issued summary judgment in favor of Apple Inc. in 2023, the U.S. Court of Appeals for the Federal Circuit revived the case in 2025, finding that the lower court had excluded some of Taction's expert testimony and made errors in interpreting the patent claims.
"There are fundamental differences between Apple Inc.'s Taptic Engine and Taction's technology, and during trial, Taction's own tests of Apple Inc.'s products confirmed this. Apple Inc. did not use Taction's technology, and we will appeal," an Apple Inc. spokesperson recently told CNBC.
Foldable screen raises selling price, AI may lead a new iPhone upgrade wave: Apple Inc.'s "experience premium defense battle"
Apple Inc. is adding two supports for its next stage of growth: high-end hardware and AI. Its first foldable iPhone Duo is priced from $1,999 in the U.S., with pre-orders scheduled to begin on October 16 and launch on October 23, and is expected to broaden the product portfolio through a higher price point and differentiated form factor. Apple Inc. can currently be described as accelerating a full shift in the center of gravity of its performance growth toward the expensive foldable iPhone and AI-related business layout.
The stronger growth catalyst with greater weight for future performance will undoubtedly be the high-end product mix upgrade brought by the expensive foldable iPhone, as well as a new round of Apple Inc. device upgrade demand brought by on-device plus cloud inference AI experiences.
The already announced iPhone Duo starts at $1,999, features a 7.6-inch inner display, and supports side-by-side operation of two apps, undoubtedly adding a higher-priced product tier for Apple Inc. For the foldable screen, the Apple Inc. AI system will be able to use the broader display space to allow users to view information on one side and interact efficiently with Apple Inc.'s AI super voice assistant Siri AI on the other, with personal context understanding and cross-app operations further improving multitasking efficiency, thereby enhancing the practical value of high-priced products.
AI also provides Apple Inc. with a new path to extend from hardware sales to recurring service revenue. Apple Inc. has stated in official explanations that some AI features relying on server models will in the future offer paid extended access. This means that AI's commercial contribution can be reflected both in hardware upgrades and in higher usage allowances and recurring service charges.
In the third quarter of fiscal 2026 ended June 27, the company's revenue was $109.4 billion, up 16% year over year, with iPhone, Mac, and services businesses all achieving double-digit growth. A new multi-year performance growth opportunity brought by AI depends on whether model capabilities can be converted into features users use frequently. Apple Inc. adopts an architecture combining on-device processing with private cloud computing, integrating personal context understanding, app invocation, and task execution with the device experience. From an engineering and investment perspective, the coordinated upgrades of Apple Inc.'s CPU, GPU, neural engine, and memory system can support more complex local AI tasks; but only when these investments upgrade willingness, user retention, and paid value will they form sustained profit contribution.
In addition, Apple Inc.'s iPhone and services revenue in the third quarter of fiscal 2026 were $54.252 billion and $30.739 billion, respectively, together accounting for about 77.7% of total revenue. iPhone Duo starts at $1,999, features a 7.6-inch inner display, and supports side-by-side operation of two apps, adding a higher-priced product tier for Apple Inc. The financial transmission logic is thisraising average selling price through a higher proportion of higher-priced models, strengthening upgrade willingness through new usage scenarios, and then expanding service revenue opportunities through device retention. According to the official schedule, Duo will begin pre-orders on October 16 and go on sale on October 23, and these growth potentials will gradually be tested as actual deliveries proceed.
Apple Inc., with a market value approaching $5 trillion, can be said to be undergoing an "experience premium defense battle"foldable screens and AI technology seek higher product value, while manufacturing costs, inference service costs, and potential patent expenses affect how much profit these values can ultimately retain. The patent damages award is a specific litigation risk, but this negative event has indeed made the market pay more attention to whether the high-end technology path and AI investment can be realized as stable profit margins and free cash flow.
