New regulations for the securities trading information system come into effect today! It is clearly prohibited to treat specific customers differently, among other rules.
On August 28, the China Securities Association and the Asset Management Association of China jointly released the "Management Specifications for Access to Securities Company Trading Information Systems (Trial)," which will be officially implemented from the date of publication.
On August 28, the China Securities Association and the Asset Management Association of China jointly issued the "Regulations on Access Management of Securities Company Trading Information Systems (Trial)", which will officially take effect from the date of publication. The "Regulations (Trial)" consists of five chapters and 33 articles, covering all regulatory requirements from entity access, behavioral prohibitions to process management and technical requirements. Among them, it is clarified that securities companies must conduct access to trading information systems in accordance with the law, prudently provide system access services, treat system access clients fairly, and must not provide differentiated arrangements of technical or business resources for specific access clients.
Securities companies are held accountable for managing external system access and are required to conduct comprehensive management throughout the process. They must thoroughly verify the qualifications of investors and fully validate relevant system functions. During the access process, they must diligently fulfill management responsibilities, strictly follow existing regulations related to trading management in the securities market, tightly control risks, and ensure that system access remains compliant, secure, and stable at all times.
After the release of the "Regulations", securities companies must, as required, establish and improve their system access management system, complete all functions of the trading system, strengthen the management of system access behavior, and effectively prevent business compliance and technical security risks. Eligible securities companies may submit a filing application to the securities industry association.
Announcement on the Joint Release of "Regulations on Access Management of Securities Company Trading Information Systems (Trial)"
In order to strengthen the access management of securities company trading information systems and maintain order and fairness in the securities market, the China Securities Association and the Asset Management Association of China jointly drafted the "Regulations on Access Management of Securities Company Trading Information Systems (Trial)". This was reviewed and approved by the seventh meeting of the eighth council of the China Securities Association and passed by online voting of the fourth council of the Asset Management Association of China, and has been filed with the China Securities Regulatory Commission. It is now published and shall be implemented from the date of publication. The "Evaluation and Certification Standard for External Access Information Systems of Securities Companies" (China Securities Association Document [2015] No. 124) issued by the China Securities Association (published and effective on June 12, 2015) is hereby abolished.
