WuXi AppTec (02359) announced that it has filed a lawsuit regarding the determination by the U.S. Department of Defense ("DoD") that the company is included on the DoD's 1260H list ("1260H determination"). WuXi AppTec strongly opposes this erroneous 1260H determination and has taken legal action to protect the interests of the company as well as its shareholders, employees, partners, and customers. Following the company's lawsuit against the DoD on June 11, 2026, the company filed a motion for a preliminary injunction with the U.S. District Court for the District of Columbia ("Court") on June 29, 2026, seeking to prohibit the DoD from enforcing or implementing the 1260H determination or taking any other actions based on the 1260H determination. The Court held a hearing on this motion on July 22, 2026. On August 7, 2026, U.S. time, the Court issued a ruling on the company's motion for a preliminary injunction. The company welcomed the Court's approval of the requested preliminary injunction. This ruling protects the company from the immediate adverse effects of the determination during the judicial proceedings challenging the 1260H determination. The company has always believed that the facts will ultimately emerge following an objective and fair judicial review. Meanwhile, the company's business continues to operate normally, and WuXi AppTec will steadfastly focus on its clients, continuously providing the high-quality services and support that clients need, benefiting patients worldwide.
