WuXi AppTec (02359) has issued a statement regarding the U.S. Department of Defense (DoD) designating the company as a "Chinese Military Company" (CMC) on its updated 1260H list on June 8, 2026 (U.S. time). On June 11, 2026 (U.S. time), the company filed a lawsuit against the Department of Defense in the Federal District Court for the District of Columbia. The company firmly believes that the DoD's decision to categorize WuXi AppTec as a CMC under section 1260H is erroneous, lacks factual basis, or legal standards support under applicable laws and precedents. To protect the interests of the company's customers, partners, employees, and shareholders, the company has requested the court to, among other things: (1) declare that the DoD's designation of WuXi AppTec as a CMC is invalid, void, and without any legal effect; (2) revoke and annul the decision to classify WuXi AppTec as a CMC; and (3) remove WuXi AppTec from the 1260H list.
