The General Offices of the Ministry of Human Resources and Social Security, the Cyberspace Administration of China, and three other departments issued a notice on regulating the release of recruitment information on online platforms.
Human Resources and Social Security Departments and Bureaus of provinces, autonomous regions, municipalities directly under the Central Government, and Xinjiang Production and Construction Corps, Internet Information Office, Telecommunications Management Bureau, Public Security Department (Bureau), and Local Financial Regulatory Bureaus, financial regulatory authorities:
In order to further strengthen the main responsibility for managing information content on online platforms, standardize the release of recruitment-related information, prevent misleading job seekers with false recruitment information, and protect the legitimate rights and interests of job seekers, the relevant work is hereby notified as follows:
1. Strengthen supervision of online recruitment service licenses. Commercial human resources service agencies release recruitment information through the internet, websites, applications, etc. in the form of text, pictures, videos, live broadcasts, etc., and online platforms provide recruitment information release and other online recruitment services for employers, they should obtain a human resources service license in accordance with the law. Local authorities should organize local online platforms to strengthen the release of recruitment information investigation. If illegal recruitment information is found, corresponding administrative supervision measures should be taken. Online platforms should promptly issue warnings, remove, restrict functionality, suspend or terminate services, and promptly report the handling situation.
2. Strengthen account registration management. As Internet information service providers, online platforms should authenticate the real identity information of registered users, implement real-name system verification for account login, further improve user agreements, and clarify rights and obligations related to account information registration, use, and management. Unit users registering and using account information should be consistent with the unit name, logo, etc., and should be in line with the nature, scope of operation, and industry type of the unit. If users do not provide real identity information or use fake organizational or personal identity information for false registration, online platforms should not provide them with related services.
3. Verify and certify account qualifications by category. Online platforms should differentiate recruitment service accounts by type, such as commercial recruitment services, public recruitment services, and employer self-recruitment, strengthen qualifications verification and certification according to the list of materials (Appendix 1), register and file, and verify at least once every six months. According to the principle of "re-audit existing accounts, strictly manage new ones," strengthen re-audit verification, notify accounts that have not been certified to complete the certification within a specified period. Accounts that have not passed the certification should be prohibited from releasing recruitment information. Employer self-recruitment accounts can only publish recruitment information for their own units (including affiliated branches).
4. Clearly indicate account qualification information. Based on qualification certification, online platforms should set a "recruitment service" tag and clearly display qualification and certification information on the account homepage. Commercial recruitment service accounts should prominently display information such as business licenses, human resources service licenses, or links on the homepage, and clearly indicate service items, fees, supervision department names, and supervision phone numbers. In case of information changes, updates should be completed within 10 working days. Online platforms should establish a system for controlling abnormal accounts. If the qualifications are not displayed or not updated in a timely manner after notification reminders, services should be suspended, and warning messages should be displayed on their account pages.
5. Standardize recruitment information format and standards. Online platforms should specify recruitment information format standards. Recruitment information should include basic information about the employer, number of positions, recruitment criteria, job duties, location, basic wages, etc., and should indicate validity period or be updated in a timely manner. Recruitment service accounts should only publish legal and truthful recruitment information. When forwarding recruitment information, the original source should be clearly labeled. Online platforms should strengthen the review and inspection of information publishing. If any information does not meet the requirements (Appendix 2), timely rectification should be done. If suspected of illegal or irregular behavior, report to the Ministry of Human Resources and Social Security and relevant regulatory authorities.
6. Prohibit illegal traffic under the guise of recruitment information. Online platforms should strengthen the regulation of online behavior of recruitment service accounts, strictly prohibit activities such as posting false recruitment information, impersonating experts or authorities, engaging in deceptive advertising, and misleading job seekers into signing agreements for "recruitment and training" or "training loans." Participating in pyramid schemes, online gambling, telecommunications fraud, among other illegal activities. Enhance algorithm and payment supervision to prevent promoting false recruitment information and establishing links with financial products unrelated to recruitment and training.
7. Strictly deal with illegal and irregular accounts. Online platforms should establish a sound risk identification model, enhance dynamic monitoring of recruitment information releases, verify the real identity of relevant high-risk accounts through national online identity authentication public services, and take measures such as popup prompts, warnings, flow restrictions, blocking, deletion, disconnection of publication links, account cancellation, etc., suspend or terminate services, and report to the Ministry of Human Resources and Social Security and relevant regulatory authorities. According to the requirements of the public security and telecommunications authorities, verify accounts related to cases and fraud, take measures such as requiring correction within a specified period, restricting functions, suspending use, and closing accounts. Establish a fast complaint mechanism, promptly review and intervene in accounts with concentrated complaints, and prohibit relevant entities from reposting recruitment information through means such as changing or reapplying for accounts and account migration.
Human Resources and Social Security Departments at all levels should strengthen the standardized management of online recruitment activities, handle suspected illegal human resources service agencies and illegal job agencies in accordance with the law and regulations, accelerate the establishment and improvement of a directory of human resources service agencies, and provide convenience for checking and comparing human resources service license information online. Internet management departments at all levels should strengthen guidance and supervision of online platforms, enhance management and disposal of recruitment service accounts. Telecommunications authorities at all levels should strengthen supervision of platforms providing number protection services, reduce the risk of job seekers' mobile phone numbers being leaked, and organize monitoring, identification, dynamic blocking, and disposal of abnormal fraudulent information and activities. Public security organs at all levels should strengthen internet security supervision, investigate criminal activities online, and deter illegal acts. Financial regulatory authorities at all levels should urge financial institutions and local financial organizations to strengthen loan review and risk control mechanisms, strictly regulate cooperation with online platforms in loan assistance business, and curb the risks of training loans. It is necessary to strengthen departmental coordination and collaboration, jointly fulfill the main responsibility of online platforms, maintain order in online recruitment, protect the legitimate rights and interests of job seekers, and create a good human resources market environment.
