The National Development and Reform Commission issued the "Regulations on Fair and Open Supervision of Oil and Gas Pipeline Facilities".
On October 16, the National Development and Reform Commission issued the "Regulations on Fair and Open Supervision of Oil and Gas Pipeline Facilities", which mentioned that oil and gas pipeline facility operating companies are the main body responsible for fair and open access to oil and gas pipeline facilities. They should establish corresponding systems in accordance with national requirements, publicly disclose and provide access to relevant information, and provide oil and gas pipeline facility services fairly and non-discriminatorily to eligible users. In the case of having service capabilities, they should not refuse to provide services to eligible users or make unreasonable demands. Oil and gas pipeline facility operating companies should comply with the pricing policies of the price supervisory authorities. If service prices are determined by government pricing or guidance, oil and gas pipeline facility operating companies should charge users according to regulations; if pricing is market-based, the fee standards should be negotiated between supply and demand sides. The original text is as follows: Regulations on Fair and Open Supervision of Oil and Gas Pipeline Facilities Chapter 1 General Provisions Article 1 To improve the efficiency of oil and gas pipeline facilities, promote the stable and secure supply of oil and gas, regulate the opening of oil and gas pipeline facilities, protect the legitimate rights and interests of oil and gas pipeline facility operating companies and users, and establish a fair, just, competitive, and orderly market order, these regulations are formulated in accordance with the Energy Law of the People's Republic of China. Article 2 These regulations apply to the fair and open supervision of oil and gas pipeline facilities within the territory of the People's Republic of China and its jurisdiction over other maritime areas. The laws and regulations related to urban gas facilities are not applicable to these regulations. Article 3 Fair and open access to oil and gas pipeline facilities in these regulations refers to the provision of oil and gas transmission, storage, unloading, gasification, and other services to eligible users by oil and gas pipeline facility operating companies for existing and operating pipeline facilities in accordance with relevant national regulations in a fair, non-discriminatory manner. Article 4 Fair and open access to oil and gas pipeline facilities should adhere to the principles of overall planning, safety protection, stable operation, fair service, and effective supervision, and must be promoted in an orderly manner in accordance with the requirements of oil and gas system reform and the construction of production, supply, storage, and marketing systems. Article 5 The energy supervisory department of the State Council is responsible for the supervision of fair and open access to oil and gas pipeline facilities nationwide. The department shall establish and improve the system and mechanisms for the supervision of fair and open access to oil and gas pipeline facilities, coordinate the resolution of issues related to fair and open access, and organize and guide dispatched agencies to carry out supervisory work related to fair and open access to oil and gas pipeline facilities.
