Recently, the General Office of the State Council issued the "Notice on Implementing National Product Standards and Related Policies in Government Procurement" (hereinafter referred to as the "Notice"), which will be implemented starting from January 1, 2026. The purpose of the "Notice" is to build a unified, open, and orderly government procurement market system, improve the government procurement system, and ensure equal participation of various types of entities in government procurement activities.
The "Notice" specifies that the national product standards in government procurement refer to products produced in China, with the cost of Chinese domestic production components reaching the required proportion, and requires that certain products have their key components and key processes produced and completed in China. This standard applies to goods involved in government procurement projects and service projects. In government procurement activities, a 20% price preference will be given to domestic products compared to non-domestic products. If international treaties or agreements entered into or jointly participated in by the People's Republic of China have other provisions on the policy of domestic products in government procurement, they shall be implemented in accordance with the relevant treaties or agreements.
The "Notice" proposes that within 5 years from the date of implementation of this Notice, the Ministry of Finance, together with relevant industry authorities, will, on the basis of fully soliciting opinions from relevant domestic and foreign enterprises, industry associations, and chambers of commerce, implement classified policies and measures in a prudent manner, to determine the proportion of component costs to be produced in China by product, as well as the requirements for key components and key processes of specific products, and establish a transition period of 3-5 years according to the development of different industries, gradually establishing a system of national product standards in government procurement and a dynamic adjustment mechanism. Before implementing the requirements related to the proportion of component costs produced in China for each product, products meeting the requirement for production in China will be treated as domestic products in government procurement activities.
The "Notice" emphasizes that government procurement support policies treat state-owned enterprises, private enterprises, foreign-invested enterprises, and other types of entities equally. All regions and departments should strengthen overall coordination and not introduce policy measures that violate the provisions of this Notice. In government procurement activities, brands cannot be designated or restricted based on their registration location or ownership, and suppliers cannot be subject to differential treatment or discriminatory treatment based on ownership form, organizational form, equity structure, nationality of investors, or other unreasonable conditions.
The "Notice" also contains provisions on the basic rules of cost calculation for domestic products and dispute resolution.
