In court documents, Musk's lawyers stated that if OpenAI cannot become a for-profit entity, Musk plans to withdraw his $974 million acquisition offer for OpenAI's non-profit division. The court documents said, "If the OpenAI board is prepared to preserve the charitable mission and agrees to take down the 'For Sale' sign by ceasing its transition, Musk will withdraw the acquisition offer." Otherwise, "the charity must be compensated by an independent buyer for the price it would pay for its assets." The court documents referenced Musk's "serious offer" to enhance the charity's goals. During the Paris AI Summit, when asked about Musk's plans to acquire OpenAI, Altman responded, "It's not taken too seriously!" He added that Musk's bidding for OpenAI may be for competitive purposes. By interfering or changing the direction of OpenAI, it could slow down its development speed, thus creating more opportunities for himself or the technology projects he supports. But he also said that he cannot be 100% sure, and even thinks very few people can fully understand Musk's true intentions. Earlier reports stated that Musk had proposed a $974 billion acquisition of OpenAI and had submitted the bid to the OpenAI board, creating significant uncertainty for the company's development. Musk sued Altman and others in August and requested a US district judge to prevent OpenAI from attempting to become a for-profit entity. Musk claims that the company's original mission was to create open-source technology free from corporate interests, but this mission has been weakened due to Microsoft Corporation being the largest investor in OpenAI. Musk criticized OpenAI for deviating from its non-profit roots and collaborating with Microsoft Corporation for profit. The lawsuit against OpenAI alleges that they have violated their mission. Although Musk pushed for a for-profit model in 2017 and sought to become CEO, OpenAI rejected his proposal.
